Conditions of Use

Terms and Conditions associated with the Acquisition of Goods

The following terms and conditions apply to all transactions on stovelounge.co.uk (henceforth known as Stove Lounge).

Please read through these carefully before placing an order and print a copy for future reference.

1. Effect of agreement
Viewing of Stove Lounge is free, but when customers use this website, this agreement becomes effective and customers reaffirm the agreement every time the site is accessed.

2. Prices of Goods
The prices customers pay are the prices displayed on the website at the time of making the order *.  This includes any delivery costs associated with the order.

* On very rare occasions the information on our site could be incorrect due to circumstances not always in our control.  If we discover an error with the price of goods customers have ordered which have not yet been received, we will inform customers as soon as possible and provide the option of reconfirming the order at the correct price or cancelling the order.  If we are unable to contact the customer (although every effort will be made), the order will either by placed on hold (temporarily stopped) or cancelled and confirmation of this will be sent out via email.  If payment has already been made for the goods and the order is subsequently cancelled, customers will receive a full refund (including shipping costs) as soon as possible.

3. Delivery
Delivery of goods purchased on the website can only be made within the United Kingdom.  For delivery costs for locations overseas, please contact us for a quote.

We aim to deliver customer’s order as quickly as possible and within the time period stated on our website when completing the purchasing process.  However, we do not have any control over the quality of service provided by the Royal Mail and courier companies we employ to deliver our goods.  Some deliveries may be late due to issues associated with location, weather, accidents, strikes or local disruptions.  In any instance, Stove Lounge cannot be liable for any consequential financial loss by a customer.  This includes any payments due by customers to third party individuals or companies which may be providing services associated with the goods purchased (for example, independent flue system installers).

We always recommend that customers do not book installers prior to receiving the stove/flue installation system.

We also encourage customers to check the goods purchased for any damage prior to signing for those goods when delivered.  While customers may not always feel this is necessary, we especially recommend this when accepting delivery of goods which are marked as fragile.  We always recommend checking a stove for any damage that may have occurred during transit prior to signing for it.  We will always try to remedy every situation where damage has occurred to goods in transit with as little inconvenience as possible to our customers and without expense to them.  In cases where we advise customers to return goods that have arrived damaged, we will provide reimbursement for the delivery costs at the rate of standard Royal Mail parcel delivery. Customers will then have the option of accepting replacement goods, or receiving a full refund (this includes the initial cost of delivery paid when ordering the goods).

If customers are aware that goods have been damaged prior to signing for them, they must sign for the goods as damaged and make sure the delivery driver is fully aware of this.  If the goods are definitely damaged on arrival, customers do have the option of refusing delivery and having the goods returned to us – customers are not charged for this.

4. Availability of goods
Goods are subject to availability.  In the event that we are unable to supply goods customers have ordered we will inform customers as soon as possible.  A full refund will be given if payment has already been received for the goods or replacement products offered.

Now some legal ‘small print’ common to all retail companies.

5. Exclusions of Liability
We will not be liable for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity even if we had knowledge that such damages or loss might arise or for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation breach of contract, negligence, wilful act or default.

We are not liable to fulfil any obligations towards you as a result of:

  • acts of god including earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost;
  • force majeure including (but not limited to) war, accidents, acts of public enemies, strikes, embargoes, perils of the air, local disputes or civil commotions;
  • national or local disruptions in air or ground transportation networks and mechanical problems to modes of transport or machinery;
  • latent defects or inherent vice in the contents of the shipment;
  • criminal acts of third parties such as theft and arson.

Please note that any advice given either via the website or by other means constitutes only guidance and suggestions. It is the customer's responsibility to ensure that all products ordered suit the purpose intended for their stove and flue installation system and that in doing so all building regulations are complied with.

All products are sold on the understanding that they wil be used in a legally compliant manner. Stove Lounge cannot accept any responsibility for any consequence resulting from an inappropriate and/or unlawful installation.

6. Cancellations
The Distance Selling Regulations provides customers with a statutory right to cancel an order and receive a full refund for any home delivery item.

To cancel, customers can email us or write to us at Customer Services within fourteen calendar days commencing the day after the day of delivery of the item(s), quoting the order number.  Upon notification you will be issued with a Returns Number which must be included as part of the Returns Address. Refunds for items returned without a Returns Number will be significantly delayed. Goods must be returned within this fourteen day period from notification. Reasonable care of the item(s) must be taken prior to their return to us.

Please note, this policy does not extend to items which are cut to order (for example, stove rope and flexible flue liner).

7. Copyright
All images and designs used on this website are property of Stove Lounge or of the copyright owners Stove Lounge has express authorisation to use.  You must not use, reproduce, modify or distribute images or content on this website in any form without written authorisation from us.  Legal action may be taken especially against other companies breaching our copyright.

8. Reasonable control
Stove Lounge shall not be liable for any failure to perform its obligations in cases where the failure was caused by matters beyond our reasonable control.

9. Breach of contract
We have the right to suspend or terminate any Contract of Sale or provision of a service if it appears to us, in our absolute discretion, that a contractual agreement has been breached.

10. Applicable law
The laws of England shall govern the contract between us and any dispute between us will be resolved exclusively in the courts of England. English is the only language offered for the conclusion of the contract.

11. Provision of Information on Website
Reasonable attempts are made to ensure that product images are current and illustrate the product appropriately, but are not always an exact representation as product design specifications do change from time to time. These are mainly cosmetic differences and do not relate to the purpose and functions of the products.

12. Price and Shipping
The prices displayed on this website include VAT but exclude shipping.  To get shipping estimates, go to the shopping basket and see the estimate shipping information.
